2026 update: SIMPLEX 2.0 (Decree-Law No. 108/2026) came into force on 1 October 2026. It kept the philosophy of the 2024 regime and cut the follow-up control period for prior notifications from 10 years to 1 — which puts even more weight on whoever signs.
Only an engineer registered with the Ordem dos Engenheiros can sign that declaration, with a competence verification code (SIGOE) and civil liability insurance. Whenever you touch the structure — opening up a wall, removing a wall, adding a storey or changing loads — you need a structural stability project signed by an engineer registered with the Ordem dos Engenheiros. It's also the document the licensing process requires.
In extension, alteration or reconstruction works, when there are clear signs of structural deterioration, when the works change the building's structural behaviour, or when the area or cost of the works exceeds 25% (15% for buildings in importance classes III and IV). That is what Portaria No. 302/2019 says. If the building doesn't meet 90% of the NP EN 1998-3 seismic action, a seismic strengthening design becomes mandatory.
